November 14 FilmOntario Updates

Fall Economic Statement

In today's Fall Economic Statement, the province has committed to expanding support for location fees in the Ontario Production Services Tax Credit (OPSTC). Specifically, they will amend the definition of "eligible tangible property expenditures" so that all reasonable expenditures paid to an arm's length party will now be eligible for the credit. This includes all location fees paid to restaurants, homeowners, stores, etc., (i.e. "leasing real property") effective for expenditures incurred after November 14, 2022. The maximum eligible expenditures for leasing real property for on-location filming that can be claimed for a production will be limited to 5% of the production's qualifying production expenditures.

The Statement also re-commits to extending both the Ontario Film and Television Tax Credit (OFTTC) and OPSTC to online-only productions, which was announced in the 2022 Budget. Regulatory amendments to implement this measure will be introduced in the coming months.

As you may recall, both of these commitments are recommendations that were made by the Ministers' Film and Television Advisory Panel, which included several FilmOntario Board members. We are delighted to see the commitments the government continues to make to working with the industry to ensure our tax credits remain effective and competitive. We look forward to continuing this work with the government and with all of you.

Finally, the government will also be introducing a regulation to require that eligible OFTTC and OPSTC productions provide an on-screen acknowledgement of their receipt of Ontario tax credit support. This requirement will be for productions that begin principal photography after December 31, 2022.

Minister Bethlenfalvy to Speak at AGM

We are pleased to announce that The Honourable Peter Bethlenfalvy, Minister of Finance, will be the guest speaker at this year's AGM. As a reminder, the AGM will be taking place on Wednesday, November 30 at 6 pm in the Museum Room at the Shangri-La Hotel.

The AGM is open to employees and members of all FilmOntario member organizations in good standing. Please join us as we celebrate our accomplishments from the past year, and look forward to what is already shaping up to be a very busy 2023.

We are delighted to be returning to an in-person gathering this year. There is also an online option for those who are not able to attend in-person.

Important Dates

November 17 – Final deadline this fiscal year for the Ontario Creates Film Fund – Production streams (Drama and Documentary). The Film Fund provides support to Ontario producers for a range of feature film projects across genres in the final stages of production financing.

November 30 – FilmOntario AGM at the Shangri-La Hotel and online. Please register in advance here.

November 30 – Applications for the Ontario Creates Film Fund – Development will be accepted on a continuous basis until this date. This program is intended to support development activities that lead to the increase of domestic feature film production in Ontario, for all stages of development activities.

December 7 – FilmOntario day at Queen’s Park. Sign up here.

January 31 – Deadline for the next round of the Skills Development Fund, which began accepting applications on September 29. This Fund supports ground-breaking programs that connect jobseekers with the skills and training they need to find well-paying careers close to home. It is open to employers, unions, industry associations and municipalities. Decisions are made on an ongoing basis.
